Let's assume that Program X has been proven beyond any doubt to be a clone of Programs Y {and Z?}. What should the end users, who purchased Program X in good faith, do with their purchases? Delete them? Use them? Feel guilty?
And what should 3d party companies that have sold Program X do with their profits?
Keep them? Refund the purchase price to the customers? Give the profits to charity? Give the profits to the wronged developers?

In that case, if someone was simply expecting a strong engine or if the cloners didn't specify how the engine was made, your objection wouldn't be a problem for them.
