Around 2002, Fide went back to the strict 50 move rule after experimenting with higher draw move limits. There was always a draw that took more moves than the Fide draw move limit. I concur that the 50-move rule has to be invoked by the player having the move. I can visualize a scenario where a checkmate is also a legal draw --> if the checkmating move is the last ply of 50-moves without a capture or pawn move, and the side being checkmated declares a draw. This was not the case here as there was a pawn move as recent as move 63.

With 6 pieces on the board how can you be sure it was the Nalimov 5-piece tbs that saw the blunder instead of the engine itself?

Addendum: The original mating example also has a symmetry factor. So its multiplicity should be 120.
