I can agree that it does seem to be an attempt to clarify what "derivative work" means "under copyright law." But it's very confusing - what if their "clarification" is actually a completely different definition from the applicable local law? Or is "derivative work" defined in broadly the same way ...

Yes. It's very simple really. Say I write a program that is not a derivative work of a GPL program (under copyright law). The GPL can now say all it wants about what it considers a derivative, it's meaningless for my program, because the GPL simply has no legal basis at all upon which to claim anyt...

Gian-Carlo Thanks for your reply. What the GPL says is irrelevant on that subject. The relevant issue is copyright law of the applicable jurisdiction. (Which indeed will vary depending on the involved parties) Are you sure about this? "Irrelevant" is a big word. The GPL is not well drafted at all. ....

BTW, although I am not a Rybka zealot, I must point out that this is an extremely misleading thread. Fabien has simply asked some questions about the Rybka-Fruit connection. Very understandably, he is not happy about the perceived links between Rybka and Fruit but he has not made any accusations. Yet.

Graham, you and I often agree about these things but Rybka's team made itself a target by crying foul when it seems they did the same thing (or something close enough). As always Vas is tight lipped. That is no help! Perhaps he is too busy "losing" all the Rybka source code on his hard drive to rep...
