Question about 3rd repetition rule and king castle condition

Hi guys,

in for example:

1-Nc3-Nc6
2-Rb1-Rb8
3-Ra1-Ra8
4-Nb1-Nb8
5-Nc3-Nc6
6-Nb1-Nb8

We have after 6... -Nb8 the same position for 3rd time.... but in fact the kings have not the same castle condition in the first (initial position) than in the 3rd (after 6... -Nb8).
Is tie for 3er repetition or it need even the castle condition of the king must be the same?

The same question could be make about enpassant condition of a pawn.

In chess, in order for a position to be considered the same, each player must have the same set of legal moves each time, including the possible rights to castle and capture en passant.

Note that turn to move must also be the same. In the twentieth game of the Bobby Fischer versus Boris Spassky World Chess Championship 1972, Fischer called the arbiter Lothar Schmid to claim a draw because of threefold repetition but the claim was actually invalid because it was not the same player's turn to move in all three instances. However the claim was accepted and the result stood.
