You can own that image, but not the fractal math that made it.
Your creative input would be (I suppose) in selection of the fractal equation and in the coordinates, and in the color palate.

I do think it is not a totally cut and dried situation.

I suggest to Albert that the simple solution to the dilemma is to encrypt the file and then read it with a decryption API.
Then it is simply a trade secret.
