If I sell something to you as X, but also mention elsewhere that it's actually Y, that doesn't fix the fact that I sold it to you as X while giving you Y.

The fact that the marketing refers to it, anywhere, as a new engine, means that people are free to call it a clone. Your original premise was that it's not a clone as it's just being sold as a network.
