He had been warned twice already, and had been told the next violation would result in forfeiture.
Akobian complained that this distracted him, and Rich had warned So twice previously in 2015 U.S. Championship that this violated the rules. Rich consulted with IA Franc Guadalupe by phone before deciding to forfeit So. Rich said he told So after the second infraction that a third violation for taking notes would result in forfeiture.
So apparently decided that writing on a separate score sheet that was not serving as his official score sheet was not covered by the rules. He seems to have been well aware of what he was doing.

Maybe I am not getting what you saying but he was warned once and then he did it again! I call that persistent.
11.7 "Persistent refusal by a player to comply with the Laws of Chess shall be penalised by loss of the game. The arbiter shall decide the score of the opponent."
from Merriam-Webster of the word persistent: "continuing to do something or to try to do something even though it is difficult or other people want you to stop"
I mean So seems to be a pretty decent person but he broke the rules and he was warned beforehand. I do not know what the arbitrator said to him but I surmise he probably told him if he continues he will forfeit the game? Maybe the arbitrator didn't say that, I do not know.

Yes...here our pals has centered in the forfeited guy and his motives, which I do not know, not even in name, BUT the behavior of Akobian is ugly. What a heck matters if someone is writing something in a sheet of paper? That sensibility for trifling things just to get something is really low.

If I understand right, the two earlier warnings were given in earlier games of the tournament. That suggests that Akobian was the third player to complain about So's behaviour.
I see nothing wrong with a player complaining that his opponent does not obey the rules. It does not mean he his doing this just to win the game. In normal circumstance such a relatively minor infraction of the rules would obviously not result in forfeiture, but if it is the third time and a very clear warning had already been given... What should the referee have done? "I told you last time that if you do it again you'll forfeit the game, but since you are Wesley So I will just warn you for a third time?"

If that is true then his behavior is even more reprehensible!

The problem is not with the judge or even with the rule, but with the guy that complain for such a trifling thing. I see something low in being so worried because the other guy write on a paper and then you make use of the rule to "complain" as if the other guys was lightning a cigar in his nose.
I do not understand those things, frankly. Even in a tournament some kind of chivalry, decency and friendly atmosphere should prevail.
I do not imagine myself yelling as mad because the adversary touch a piece by chance and I compel him to play it because it is good for me. LOW.
