Can he not just post some games were an engine defeated Rybka 2.3.2 and edit the headers?

This procedure takes some time, the games have to be unpublished, so it's not an easy task :-)

That is a great improvement for a clone. :)
If a clone is more than 120 elo better than its source, it may not be a clone anymore. It may be a new engine. (Rybka´s case)

the author credit and rename it. It is than a legal clone
as in the case of (Toga) :)
