I do not see how richard can counter sue because houdini did not take things from critter based on my knowledge.
If the claim is that Houdini took things from stockfish or from ippolit then Richard is not the author of these programs so it is not relevant for him.

Hi Uri-
Nor sure, but i think Gerold might have meant:
if Houdart sues (and Richard believes it's frivolous, or can't be proven)...then a counter suit (for defamation) is possible

i'm kind of crossposting (with edits) from
http://talkchess.com/forum/viewtopic.ph ... 3&start=58
here because i believe it's even more relevent here

IMO:
Robodini was a simple mistake of judgement
Richard Vida is not 'just' a programming superman, this demonstrates he is clearly a human being as well

i don't understand how Strelka is any different...
the author bases his releases on the decompiled sources of the strongest engine available at the time
1st Rybka 3, now Houdini, and he openly admits it

many have accepted Strelka into their rating lists, and many are testing it
yet, there are no law suit threats from Houdart
(perhaps he sees Critter as a bigger threat to Houdini's dominance)?

all in all, i believe R. Houdart vs R. Vida is extremly unlikely, i see it as all bark and little bite...
(what a huge, expensive, and dangerous undertaking it would be to try to prove plagiarism)

i'm not sure why Richard is being singled out in this regard, he apologized, and most have moved on,
perhaps Houdart should as well..

in any event, i would like to encourage Richard here,
and i hope that any new Critter release will be received openly and fairly

i agree with you Ray,
but i'm sure they would reconsider their position if a major lawsuit came to light
(which is highly unlikely IMO)

I agree with you Norman. I don't understand why Robert states he will sue Richard.
Vas said he would sue Yuri Osipov over Strelka also but quickly backed down when put to a test.
In a lot of civil type law suits over money etc. it is just about automatic for the other side to file a counter suit for whatever reason.

Best,
Gerold.

P.S. Chess base will sell any program that can make a buck for them that has not been declared illegal by the courts. If one is declared illegal it will be dropped like a hot potato. As it is now Chess base is in the clear.

You are supposing chessbase will do a investigation about the product previous to sell. And because that you reaching a false conclusion. Its a business, and they offer what its hot. If komodo (6?) gets 1st place they will run and make a deal with Don.

They are selling products, and if there is a problem they will claim they trusted in good faith the authors (Vas, Houdart or any other).

They can claim their (chessbase) money is because the GUI, packaging, marketing, shipping, etc and they are not profiting from engines because that % money is given to authors.

No I'm not assuming that they do that, in fact I'd be surprised if they did do it. What I said was that they would not knowingly sell an illegal product, or a product that they had doubts about.
