Will this version be sent to Chessbase? If they could produce a 64 bit as well it would be great!

I don't really send anything to ChessBase.... They just grab the source whenever they choose and make something everyone can download...

Are they allowed to do that without publishing the changes in source?

yes, because they don't change crafty itself, they just add whatever stuff they add to handle their non-winboard based protocol...
