I may have to read it again, but I do not recall Max actually denying an involvement with Hans concerning cheating an Magnus' insinuations. Of course, if he did not...it is logical to argue that alone might good enough reason to not bother with the question.
One could argue that picking apart individual games for 'where an engines says you should do x,y or z' as opposed to what you played is probably no more sound an argument than someone picking out where your moves agree with an engines moves...or top 2 moves.
Do we know for sure Chess.com kicked him out of that tournament solely on games played in that tourney? Perhaps they have a rolling window of...say 20 games and if in any such span certain metrics are found, THEN you are flagged. I'm saying...if so, one might look at 10-15 (whatever fits in the window) games prior to this tournament as well.
Noticed dkappe's comment. Yes, but the difference it could be argued is that we have the cheating in all its 'glory' in the Magnus video. In Max's situation...we have only his word for what happened. He may have been using an engine, we don't really know.
